Balance Due: $500
The balance is due 14 days before the date of the wedding.The videographer will not deliver the wedding video to the CLIENT until the full balance has been paid. The deposit is due within 7 days of signing this agreement.
Reservation: A signed contract and deposit are required to reserve the specified coverage.
Expenses: The Client is responsible for all travel, accommodation, meals, and transport costs unless provided by the client or included in the wedding package (listed above).
Entire Agreement: This agreement contains the entire understanding between Eterna Films and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change the agreement is to do so in writing, signed by all parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is also waived.
Pre-Event Videography: If the bride or groom's late arrival prevents the videographer from capturing anticipated video footage, the videographer shall not be held liable for failure to take desired video.
Cooperation: Eterna Films recommends that the CLIENT designate an "event guide" to point out important individuals for informal or candid video to the videographer during the wedding that they wish to have filmed. Eterna Films is not responsible if key individuals fail to appear or cooperate during the wedding day or for missed video coverage due to details not revealed to Eterna Films.
House Rules: The videographer is limited by the guidelines of the ceremony official or reception site management. CLIENT agrees to accept the technical results of their imposition on the videographer. Negotiation with the officials for moderation of guidelines is the CLIENT's responsibility; Eterna Films will offer technical recommendations only.
Drone Limitations: Applicable drone videography can be limited by weather and FAA restrictions if the location is near an airport or other no-fly zone. Drone coverage may be limited or restricted by inclement weather (high wind, cold, or precipitation).
Video Copyrights: Eterna Films retains the copyright on the video footage captured for the CLIENT's wedding. After final payment for services has been made, the CLIENT may use their wedding video in any manner they desire.
Model Release: The CLIENT hereby grants to Eterna Films and its legal representatives, the irrevocable and unrestricted right use and publish video of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium, except where defamatory. This includes, but is not limited to, the website, blog, and Facebook page of Eterna Films/Montana Filmmaker.
Limit of Liability: The videographer takes the utmost care with respect to capture, transportation, and storing the video footage. However, in the unlikely event that video footage has been lost, stolen, or destroyed for reasons within or beyond Eterna Films' control, Eterna Films' liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of footage shall be a prorated amountof the footage lost compared to the total footage captured.
Security Deposits: In the event of cancellation, the security deposit paid is nonrefundable.
Completion Schedule: A draft of the highlight video and feature length video will be sent as a streaming video to the bride and groom approximately 6 to 8 weeks after the wedding date. The final wedding disc will be postmarked within one week of approval by the bride and groom.
